License Agreement

DataDino Binary Software License Agreement

IMPORTANT - READ CAREFULLY: YOUR USE OF THIS SOFTWARE (THE "PROGRAM") IS SUBJECT TO THE SOFTWARE LICENSE TERMS SET FORTH BELOW. THE "PROGRAM" INCLUDES ALL SOFTWARE INCLUDED WITH THIS AGREEMENT. BY INSTALLING AND/OR USING THE PROGRAM AND ANY SOFTWARE PROGRAMS INCLUDED WITH THE PROGRAM, YOU ACCEPT THE TERMS OF THIS LICENSE WITH DATADINO AND JERASON BANES.

Limited Use License

Subject to the conditions described below, DataDino and Jerason Banes grants you the non-exclusive, non-transferable, limited right and license to install one copy of the Program solely and exclusively for your personal use. All rights not specifically granted under this Agreement are reserved by DataDino, Jerason Banes and their Affiliates. The Program is licensed, not sold, for your use. Your license confers no title or ownership in the Program and should not be construed as a sales of any rights in the Program.

License Conditions

You agree:

You are not a citizen, national or resident of, and are not under the control of, the government of: Cuba, Iran, Sudan, Iraq, Libya, North Korea, Syria, nor any other country to which the United States has prohibited export.
You will not download or otherwise export or re-export the Programs, directly or indirectly, to the above mentioned countries nor to citizens, nationals or residents of those countries.
You are not listed on the United States Department of Treasury lists of Specially Designated Nationals, Specially Designated Terrorists, and Specially Designated Narcotic Traffickers, nor are you listed on the United States Department of Commerce Table of Denial Orders.
You will not download or otherwise export or re-export the Programs, directly or indirectly, to persons on the above mentioned lists.
You will not use the Programs for, and will not allow the Programs to be used for, any purposes prohibited by United States law, including, without limitation, for the development, design, manufacture or production of nuclear, chemical or biological weapons of mass destruction.

You agree not to:

Sell, rent, lease, license, distribute, or otherwise transfer this Program, or copies of this Program, without the express, prior, written consent of DataDino or Jerason Banes.
Use the Program, or permit the use of this Program on more than one computer, computer terminal, or workstation at the same time.
Make copies of the Program or any part thereof, except for back up or archival purposes, or make copies of the materials accompanying the Program.
Reverse engineer, derive source code, modify, decompile, or disassemble the Program, in whole or in part.
Remove, disable or circumvent any proprietary notices or labels contained on or within the Program.
Export or re-export the Program or any copy or adaption thereof in violation of any applicable laws or regulations.

Ownership

The program is Protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. All title, ownership rights and intellectual property rights in and to the Program and any and all copies thereof are owned by DataDino and Jerason Banes, excepting the following software:

The jTDS driver used for connecting to SQL Server is licensed from CDS Networks, Inc. and the jTDS project under the following conditions:

The Oracle JDBC driver is copyrighted by and licensed from Oracle Corporation.
The MySQL driver is copyrighted by and licensed from the mm MySQL project.
The PostGreSQL driver is copyrighted by and licensed from the PostGreSQL Foundation.
The IBM DB2 driver is copyrighted by and licensed from International Business Machines (IBM).

Warranty

No warranty is expressed or implied save for replacement of defective media provided by DataDino or Jerason Banes.

Limitation of Liability

IN NO EVENT WILL DATADINO, JERASON BANES, OR THEIR AFFILIATES BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE PROGRAM INCLUDING DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, EVEN IF DATADINO, JERASON BANES OR THEIR AFFLIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DATADINO AND JERASON BANES' LIABILITY SHALL NOT EXCEED THE ACTUAL PRICE PAID FOR THE LICENSE TO USE THIS PROGRAM.

Termination

Without prejudice to any other rights of DataDino and Jerason Banes, this Agreement will terminate automatically if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the program.

Indemnity

You agree to indemnify, defend and hold DataDino, Jerason Banes, its partners, licensors, affiliates, contractors, employees and agents harmless from all damages, losses and expenses arising directly or indirectly from your acts and omissions to act in using the Product pursuant to the terms of this Agreement.
